These Terms and Conditions (hereinafter, "the Terms") govern the use of the Descarboniza platform accessible at https://www.descarboniza.es, owned by Jesús Morán Morán (Tax ID 44789317Z), with registered address at Calle Villafranca 77, Almendralejo (Badajoz), Spain.
Use of the Website — whether as a visitor, registered user or subscriber — implies full and unreserved acceptance of these Terms, as well as of the Legal Notice, the Privacy Policy and the Cookie Policy.
Descarboniza is an editorial platform and set of digital tools for the sustainable construction sector. It includes, among others:
The scope of these features may evolve. Descarboniza reserves the right to add, modify or withdraw tools and content at any time.
Certain features require creating an account. Registration and authentication are handled by the provider Clerk Inc. ("Clerk"). By registering, you accept, in addition to these Terms, Clerk's terms insofar as they affect the authentication process.
The User undertakes to provide truthful information, keep it up to date, and safeguard their login credentials. The User is responsible for immediately reporting any unauthorised use of their account to hola@descarboniza.es.
Descarboniza may suspend or cancel accounts that breach the Terms, misuse the platform, or infringe third-party rights.
Some features may require a subscription plan. The features, prices and duration of each plan are published on the /plans page and, where specific, prevail over the general provisions of these Terms.
Payments are processed through specialised external providers (for example, Stripe). Prices are expressed in euros and include, where applicable, the relevant taxes. Descarboniza does not store card details.
Unless otherwise stated, subscriptions renew automatically at the end of each period. The User may cancel the renewal at any time from their account or by emailing us, with the cancellation taking effect at the end of the current period.
Right of withdrawal (consumers): under Royal Legislative Decree 1/2007, consumer Users have 14 calendar days to withdraw from the contract, unless they have started using the digital service with their express consent and with knowledge that they thereby lose that right. To exercise it, simply send an email to hola@descarboniza.es stating your wish to withdraw.
The calculation and comparison tools — comparator, CTE HE thermal calculator, radon calculator, CAE scanner, carbon-footprint comparisons, etc. — provide indicative estimates based on public data, verified EPDs and current regulations.
The results do not replace the professional judgement of architects, engineers, qualified technicians or legal and tax advisors. The final decision on any project, material or construction solution rests entirely with the User and their technicians.
Descarboniza does not guarantee the accuracy, completeness or real-time updating of data provided by third parties (manufacturers, verification bodies, public administrations) and disclaims any liability for technical, financial or legal decisions made on the basis of the tools or the directory content.
Professional Users may request the publication of company, material, project, EPD or other sector-related listings. By submitting content to Descarboniza, the User:
Descarboniza will remove, as promptly as possible, any content subject to a well-founded claim of infringement of third-party rights.
The User undertakes not to use the Platform to:
Breach may result in immediate suspension of the account and, where applicable, the pursuit of appropriate legal action.
The editorial content, design, source code and organisation of information are owned by the site owner or its licensors. Granting access to the Platform does not imply any waiver, transfer, or full or partial licence of intellectual or industrial property rights.
The User may view, print, copy and store content solely for personal and individual professional use, always citing the source. Commercial redistribution without written authorisation is expressly prohibited.
Descarboniza undertakes to use reasonable means to keep the Platform operational, but does not guarantee uninterrupted availability. Downtime may occur due to maintenance, updates, technical incidents or force-majeure causes, without giving rise to any compensation.
Descarboniza may amend these Terms to adapt them to regulatory, technical or business changes. The version in force will always be the one published on this page, indicating the date of the last update. Continued use of the Website after publication of a new version implies acceptance of it.
These Terms are governed by Spanish law. Disputes shall be submitted, save for any mandatory rule to the contrary, to the Courts of the consumer's domicile when the User acts as a consumer, and otherwise to the Courts of the owner's domicile.
In accordance with Regulation (EU) 524/2013, consumers resident in the European Union may access the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr.
